 1.⁠ ⁠I did not go to Israel for politics. I did not go to add my voice to the noise of pundits and spin. Nobody—not Israel or anybody else—offered to pay me anything; nor would I ever consider such an exchange. I went for one reason: to see if God’s children could be saved from violent jihadist militants.

 2.⁠ ⁠I needed to see with my own eyes. I needed to hear with my own ears. Because when the world cannot agree on the truth, the only way forward is to stand where the suffering is, to hold their words in your hands, and to look into the eyes of God’s little ones.

 3.⁠ ⁠Let me first say what must be said. Were there atrocities from both sides in the Gaza conflict with Israel? Yes. There always are in war, and it is never excusable. Is Israel perfect? No. It never has been, from Old Testament days to New Testament days, until now.  Has Israeli intelligence been involved in unsavory activities? Almost certainly. But does America not have skeletons just as dark, or perhaps darker? Of course. But I still wear the American flag as a hope for the ideal-a hope for what ultimately, some day, will be. 

 4.⁠ ⁠And the big question: Did Israel go too far in its response to the October 7 Jihadist attacks? The Western media is convinced it did, and are writing the whole thing off as “Genocide”. Period. 

 5.⁠ ⁠But what if it was YOUR daughter that was kidnapped and being beaten and gang raped, over and over, in hidden Gazan bunkers and tunnels? What if it was YOUR wife? As a matter of demographic comparison, what Hamas did to Isreal would be akin to, say, the Nicaraguan army crossing our southern borders and, after killing over 44,000 of our citizens,  kidnapping, beating, raping, and holding hostage close to 10,000 of our daughters, sons, nieces and nephews. Imagine this. How bad would you want your people free? At what point would you tweet out, or yell at your president, that it is time to consign your daughter or mother to a life of sex slavery in Nicaragua, because you can no longer stomach the destruction inside Managua?

 6.⁠ ⁠Do you really want to stand 3,000 miles away from all of this, and then judge how far is too far? 

 7.⁠ ⁠Many are understandably horrified by the destruction in Gaza, but they don’t consider how Hamas had built an extensive terror tunnel network beneath homes and public buildings, longer than the NYC subway system. The idea is for Hamas soldiers to hide in these tunnels, along with Israeli hostages, knowing that all the cities above, and the people living there, automatically become human shields. And if Isreal dares counter-strike the militants in the tunnels, in an effort to get their people back and deter further attacks, they will be killing innocent people above. And that’s exactly the point. Hamas then cries foul and “genocide” to the Western media, who they know don’t have the time or inclination to figure out this whole tunnel scheme. So Western society simply parrots the media and also cry “Genocide.” And, as per Hamas’ plan, Israel is the international villain, and a new state of terror, like Iran, will perhaps be born of it. 

 8.⁠ ⁠To ensure these tunnels can never again be used to harm or exploit Israeli and Gazan children, Israel destroyed all the structures above them—a harsh reality that's hard to grasp for those who refuse to see it for themselves. 

 9.⁠ ⁠Notwithstanding, some have even gone so far as to compare the destruction in Gaza to Harry Truman’s 1945 decision to drop nuclear bombs on Hiroshima and Nagasaki. Is that crazy? No, it’s human. I have studied Truman’s decision until I’ve been blue in the face. Yes, there was a consensus in the United States that it was the only option to end World War II once and for all, and end it for everyone. 

10.⁠ ⁠There was also an even stronger consensus amongst millions of Japanese mothers and children who, very understandably, believed that only the devil himself could have ordered such indiscriminate death and destruction upon the innocent. I try to understand both sides of the argument, and I have determined that I wil never be settled with it. And I hope to God I never will be.

11.⁠ ⁠But Im also not alone. A deep study of Truman will conclude that he himself went to his grave unsettled with it. Because he, like most of us, was, in fact, a descent human being. In fact, as American presidents go, he was actually one of the most decent presidents America has ever known. War is hell. And hell is hopelessly  incomprehensible. 

12.⁠ ⁠Another applicable, thought-provoking question, that may  directly apply to October 7 and the Gaza destruction. With decades now separating us from Truman’s fateful decision, consider now who you think those Japanese mother’s would blame more for the vast destruction of their homeland. Emperor Hirohito, who ordered the unprovoked bombing of Pearl Harbor on December 7, 1941–thus “awaken[ing] the sleeping giant”?, as Japanese Admiral Yamamoto reportedly feared?; or Harry Truman, for responding? 

13.⁠ ⁠Another parallel should be considered when thinking upon the overwhelming Israeli response to October 7. What was America’s response to the 9-11 attacks? Whoever was ultimately responsible for those attacks, was the U.S. response not totally over the top? How much death and destruction did America bring to innocent Afghanis and Iraqis? Thousands of Americans killed on 9-11; hundreds of thousands of Middle Eastern civilians killed in response. Is America also Genocidal maniacs? Why do the same anti-Israeli podcasters splash American flags all over their marketing?; why do they still honor America’s brave soldiers who fought in these “forever-wars”?

14.⁠ ⁠Yet they would just as soon don a swastika on their hats as they would a Star of David; and just as soon interview a member of the Gestapo, as they would share the same air with an Israeli IDF- soldier. 

15.⁠ ⁠I’m not justifying either of these actions against innocents. I’m just asking for perspective. And I’m hoping that perhaps  future Israeli-Palestine history will provide more clarity on this almost impossible situation. 

16.⁠ ⁠In the meantime, let’s do what we can now for all the children involved. And to do so, we must accept this reality: Hamas is desecrating God’s children.

17.⁠ ⁠I met families who told me how those who tried to flee, after Isreal publically warned them that they were commencing their counter-offensive, were gunned down — not by Israel, but by Hamas. Mothers told me how Israeli-gifted food for their children was seized by their terrorist leaders, Hamas, and sold on the black market. Gazan women described how their little ones were forced to the front lines, used as human shields for militants. 

18.⁠ ⁠Even though Western media don’t want you to know about this oppression by Hamas of their own people; they must turn a blind eye to Hamas leaders who openly brag about it. On January 17, 2017, Hamas leader, Ismael Haniyeh, an architect of the October 7 slaughter, declared: “Children are tools to be used against Israel. We will sacrifice them for the political support of the world.” Then, immediately after the October 7 attack, Haniyeh again bragged, this time on a television interview, saying, “We need the blood of women, children, and the elderly of Gaza—so it awakens our revolutionary spirit.” 

19.⁠ ⁠This is not liberation. This is not defense. This is the desecration of God’s children. And let me be clear: God’s children are not for sale. They are not pawns for profit, for power, or for propaganda.

20.⁠ ⁠I made entry into Syria’s war-zone in the midst of the October-7th-like terror being viciously hurled upon Druze and Christian villages. I witnessed volunteer Israeli IDF soldiers and physicians already forward deployed, bravely providing rescue and recovery services for both Druze and Christian sufferers. I watched an 8-year-old girl , named Cristina, die two feet in front of me. I, for one, DID think of my own daughters. 

21.⁠ ⁠I heard the voices of clergy in Syria, like Father Tony Boutros of As-Suwayda, who pleaded with the world from his burned church: “We Christians, along with our Druze brothers, have always lived together in safety and security… but now our churches and homes have been burned. What happened to us is an inhumane act, and the world must look at us.”

22.⁠ ⁠His words confirm what I have witnessed: faith communities under fire, children in danger, lies spreading faster than truth. And yet, there is hope. I have seen Druze and Christian families stand against this same darkness. Unlike in Gaza, their faith almost immediately exposed the lies—exposed the jihadist’s dark and deceptive strategy. The truth about politicized Islam was getting out, notwithstanding the Western media’s near silence over the death of these massacred little ones.

23.⁠ ⁠Which begs another question. Why? Why has the Western media been virtually silent about the massacres of Christian and Druze? And yet, they have been caught, not only screaming uncontrollably about casualties in Gaza, but even fabricating numbers in order to paint Israel as the genocidal monsters they clearly want them to be. The Free Press, among others, have well documented this Western media fabrication. Everyone from the the New York Times to CNN have been complicit; showing pictures of sick Gazan children, with pre-existing health issues, but pretending their ailments  were due to an Israeli forced-famine. Not only is it an immoral smear on Israel, it’s exploitative to these Gazan children. It’s putting politics over children and it’s truly disgusting .

24.⁠ ⁠And what of the true Gazan casualty numbers? Media whistleblowers and watch-dog groups have successfully unmasked the truth: the casualty numbers are only being reported by Hamas propagandists, to the point that, even the UN, had to almost half the number of Gazan casualties from their original reporting.

25.⁠ ⁠And yet, while Western media lie about the casualties in Gaza, they say nothing about the truth that’s happening to Christian and Druze just up the road.

26.⁠ ⁠But the Christian and Druze have bravely been able to speak for themselves. They are regularly sending videos out of massacred and bloodied women and children, as jihadist bullets and bombs come crashing down on all of them. Even as I write this report, I am working daily, hourly, with brave Druze and Christian journalists inside the war-zones, who send me constant reports and raw videos, risking their lives to do the job the New York Times refuses to do. Indeed, Western media is too busy fabricating reports against Israel, and instead turn their noses up to beaten, raped, and bloodied Christian and Druze babies.

27.⁠ ⁠I do not mean to offend my Druze and Christian sisters and brothers by comparing them to Gazans, who they rightfully see as their enemy—an enemy who has spilt the blood of their children. I’m only holding out hope that the Gazan people, like the Druze and Christians,  are recognizing who their closest, most direct, enemy actually is. Some say I’m crazy for holding out this hope. After all, Hamas and its surrogates shamelessly force Gazan children to chant “death to Isreal, Death to America.” They are raised to hate and kill innocent people. 

28.⁠ ⁠But they also said Ronald Reagan was crazy for believing that the people of the Soviet Union, as a whole, were not necessarily responsible for the estimated 20 million deaths under Stalinist ideology. The Soviet people were also supposed to have been too far gone—too brainwashed. And yet, Reagan, sensitive to God’s love and mercy to every individual, identified what he called “the underground church” which was being directed by what he called “the Divine Plan.” And in the end, when the impossible happened, even as the Berlin Wall fell, Reagan was at least mostly vindicated. 

29.⁠ ⁠Critics will inevitably say I can’t compare these two. And they will provide multiple good reasons. We will debate this issue further. 

30.⁠ ⁠But the social and spiritual revolution that happened in the dying days of the Soviet Union was, nevertheless, impossible. And I will always believe in the impossible, especially in the furtherance of the  liberation of all God’s children. 

31.⁠ ⁠I choose to have the hope of Reagan, even at the risk he took of being called ignorant and nieve. My world-vision is one seen principally through the eyes of children—all children, regardless of political ideology. Children do not belong to any political ideology. And that’s why I do not, either. And I have observed that when the well-being of children is the first and last question one considers when devising policy, the impossible often comes to pass. Heaven knows, nobody deserves it more. Yes I, like Reagan, am a firm believer in “divine plans.”

32.⁠ ⁠And so, yes, I do hold out hope. And I hope that the voices of Gazan mothers and their children can, like that of the Druze and Christians, find their way out, through the complicit and deceptive voices of the Western media, so true and lasting liberation may be an option for them as well. Some groups, such as the Center for Peace Communications, have already been successful in getting these otherwise  silenced Gazan voices out to the world. 

33.⁠ ⁠Perhaps these voices can stir a revolution. Perhaps these voices can lead the innocent children to some sort of relocation, to some other land free from terrorist rule. We shall see. 

34.⁠ ⁠In the meantime, the inkhorn is being filled. Every betrayal, every child raped, every baby starved, every church burned, every reporter’s misleading pen, every podcaster’s uninformed voice, every mother’s silenced plea— it is all being written down. History and heaven will remember who defended God’s children, and who betrayed them.

35.⁠ ⁠I went to Israel not to argue, but to testify. I saw it. I heard it. I believe it. And I will not be silent.

European Natural Gas Futures and U.S. Crude Output Surge

On February 9, European gas storage was only 49% full, significantly lower than the previous year’s 67% for the same period and below the 10-year average of 51%. The decrease in gas imports, notably from Russia and Norway, has exacerbated the region's energy challenges. Analysts at Standard Chartered predict that unless temperatures normalize, inventories could finish March at just 39.1 billion cubic meters (bcm), almost 29 bcm less than last year.

Meanwhile, in the U.S., crude oil output has seen a marked increase. The latest Energy Information Administration (EIA) report indicates a rise of 238,000 barrels per day (b/d) to 13.478 million b/d, effectively reversing weather-related disruptions. However, U.S. oil production growth is expected to slow in the coming years, with predictions for modest increases in 2024 and 2025.

Sanctions on Russian Energy and EU's Strategic Response

As part of ongoing efforts to address the geopolitical fallout from Russia’s invasion of Ukraine, the European Commission is proposing a new round of sanctions on Russia and Belarus. These sanctions, which target Russian aluminum, media outlets like TASS, and the "shadow fleet" that facilitates Russian oil exports, come at a time when Europe remains heavily reliant on global energy supplies.

Although the EU refrains from imposing new restrictions on Russian LNG imports due to concerns over energy prices, the proposed measures reflect the EU’s cautious approach to balancing security, energy needs, and economic relations.

On that note, as energy prices remain high, European industrial demand for natural gas has weakened. Iraq's Fuel Smuggling Network Generates $1 Billion for Iran

The smuggling operation diverts between 500,000 and 750,000 metric tons of heavy fuel oil monthly, equating to roughly 3.4 million to 5 million barrels of oil. This operation has reportedly contributed to a yearly profit of $1 billion for Iran. The illicit fuel trade has long been a point of contention, with U.S. lawmakers raising concerns about Iraq's involvement in helping Iran evade international sanctions.

Earlier this year, a group of U.S. congressmen called for an investigation into Iraq’s Oil Minister, Hayyan Abdul-Ghani, accusing him and other Iraqi officials of participating in the illegal movement of oil, allegedly sold to Iran and further transported to countries such as Afghanistan and Pakistan.

Meanwhile, Saudi Arabia has seen a boost in its oil exports to Asia, with data from LSEG Oil Research revealing a 550,000 barrels per day (bpd) increase in November. Saudi exports to Asia surged to 5.83 million bpd in November, up from 5.28 million bpd in October. This increase came despite the rise in the official selling prices of Saudi grades for Asia, which went up by $0.90 per barrel for Arab Light.

This increase is attributed to recovering Asian refining margins and a decline in the premium of the Dubai benchmark over Russia’s Urals crude. Additionally, rising shipping costs from Russia’s western ports to India have made Saudi oil more competitive. In contrast, Russia’s oil exports to Asia fell by 450,000 bpd in November, primarily due to reduced demand from key markets, China and India.

In the past 24 hours, the Israel Defense Forces (IDF) launched military operations in Jenin, located in Judea and Samaria, and continued ongoing operations in the Gaza Strip. These engagements resulted in the elimination of dozens of terrorists. Simultaneously, the chief prosecutor at the International Criminal Court (ICC) announced plans to file a request for arrest warrants against Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant.

Early Tuesday morning, Israeli security forces, including the IDF and Shin Bet, launched a counter-terrorism operation in the Jenin refugee camp. Upon entering the city, Israeli forces were met with heavy gunfire from terrorists. The battle is ongoing, with at least ten terrorists eliminated and no Israeli casualties reported so far. Prior to the ground operation, the Israeli Air Force conducted strikes targeting senior terrorists in the city, including Islam Khamaisa, who was responsible for several attacks against Israeli citizens.

 IDF soldiers from various brigades, including the Parachute Brigade, 460th Brigade, and 7th Brigade, are engaged in intense battles in the heart of Jabaliya. The fighting has resulted in the elimination of dozens of terrorists and the confiscation of large stockpiles of weapons and ammunition. In Rafah, soldiers from the Givati Brigade and 401st Brigade are also inflicting heavy losses on Hamas, destroying rocket launchers and weapons stockpiles. The IDF is working to locate and destroy terrorist tunnels used for smuggling weapons and internal movement.

An IDF air strike eliminated Kasem Skalawi, a senior Hezbollah commander responsible for planning and executing rocket attacks on Israeli civilian communities and coordinating anti-tank missile fire against IDF troops along the northern border.

ICC Chief Prosecutor Karim Khan announced his intention to request arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, alongside warrants for Hamas leaders. This announcement has raised concerns among the Israeli defense establishment, fearing the pursuit of warrants against senior IDF officials. Emergency meetings have been held between legal officials in the IDF and various government ministries to address the issue.

The United States and other Israeli allies have issued statements condemning the ICC Prosecutor's move. U.S. President Joe Biden described the decision as a "scandal," emphasizing that there is no equality between Israel and Hamas. Israeli Prime Minister Benjamin Netanyahu also criticized the decision, calling it "absurd and false" and questioning the audacity of comparing Hamas to the IDF. U.S. Secretary of State Antony Blinken rejected the comparison made by the prosecutor, calling it "shameful" and reaffirming U.S. support for Israel.

Iranian President Ibrahim al Raisi, Foreign Minister Hossein Amir-Abdollahian, and other regime officials died in a helicopter crash on Sunday evening. The delegation was returning from a meeting with Azerbaijani counterparts when the helicopter went down in heavy fog in a remote, mountainous region. Search and rescue efforts took over 14 hours to locate the wreckage.

Al-Raisi, 63, was widely viewed as the likely successor to 85-year-old Supreme Leader Ali Khamenei, who is in poor health. Al-Raisi was a strong supporter of the Islamic Revolutionary Guards Corps and known as the "butcher of Teheran" for his role in the brutal crackdown on anti-regime protesters in 2022. His death is expected to cause significant political upheaval within the Iranian regime.

The IDF has discovered over 50 tunnels built by the terrorist organization Hamas running under the border between Egypt and the southern Gaza city of Rafah. Soldiers from the 401st Brigade have been working to eliminate terrorists and demolish tunnel shafts in the area. Rafah is a major center for smuggling weapons, narcotics, people, cash, and other contraband.

US Military Constructs Pier for Humanitarian Aid 

The US military has completed construction of a floating pier in Gaza City for the delivery of humanitarian aid. Trucks carrying aid have already begun using the pier, with more aid being stockpiled in Cyprus for security screening before being shipped to Gaza. The US Department of Defense emphasizes that American soldiers will not set foot on Gazan soil and that aid distribution will be handled by the UN and World Food Program.

Hamas Holds Israeli Hostages, Including Children 

The IDF has found footage and materials related to Israeli hostages held by Hamas in Gaza, including 8-year-old Ella Alykim, who was abducted from her father's house in Nahal Oz on October 7. In a video, Ella is seen asking Prime Minister Netanyahu to free her and other prisoners. Hamas has been using these hostages for propaganda purposes, forcing children to take pictures and videos in front of Hamas flags.

Implications of Raisi's Death for Iran and the Region 

The death of President Al-Raisi and Foreign Minister Amir-Abdollahian is expected to cause significant challenges for the Iranian regime. Amir-Abdollahian was fluent in Arabic and had good relations with many counterparts in the region and on the international stage. While the Iranian strategy is not expected to change immediately, the Islamic Republic will face difficulties in managing internal affairs and external hostilities against Israel through its proxies, Hamas and Hezbollah.

The IDF conducted airstrikes on Hamas targets in Gaza and Hezbollah in Lebanon, resulting in casualties on both sides. Egypt announced legal action against Israel at the ICJ and threatened to suspend the Camp David Accords. The IDF released footage of Hamas terrorists operating within a UN facility in Rafah.

BREAKING: IDF NEUTRALIZES 15 Hamas Inside UNRWA School; RETURNS To Central Gaza | TBN Israel

Gaza Strip - The Israel Defense Forces (IDF) and Shin Bet security service announced they killed approximately 15 terrorists at a United Nations Relief and Works Agency (UNRWA) school in the Nuseirat refugee camp in central Gaza. The airstrike targeted a Hamas combat room within the school, which the IDF claims was used to plan attacks against IDF forces. The IDF stated they took precautions to minimize civilian casualties.

13 IDF soldiers were wounded in two separate incidents in Gaza, with four in serious condition. The IDF issued evacuation notices to residents of several neighborhoods in northern Gaza, citing Hamas' use of the area for terrorist activities and rocket launches.

In Rafah, heavy fighting was reported between the IDF and Hamas as Israeli tanks advanced into eastern neighborhoods. The IDF also launched a second campaign in eastern Jabaliya after detecting a buildup of Hamas fighters attempting to regroup in the city. Several underground bunkers, tunnels, and rocket launchers were found and demolished.

The IDF released drone footage showing armed Hamas terrorists operating within a UN facility in eastern Rafah, a major logistics hub for the UNRWA aid agency. The video shows terrorists standing near clearly marked UN vehicles, with UN personnel appearing unconcerned by their presence.

Attacks In southern Lebanon, an IDF strike eliminated Hezbollah field commander Hussein Maki and his deputy while they were traveling by car in the city of Tzur. In recent days, the IDF has completed the construction of four large outposts along the Netzer clearing corridor, providing a semi-permanent camp for use by hundreds of soldiers from two reserve brigades. One brigade is responsible for securing the construction of a pier built by the US Navy and Army for supplying humanitarian aid to Gaza City. Other infrastructure has been built to monitor the security situation, including communications equipment, cameras, and expanding cellular service.

The IDF recently observed hundreds of Hamas terrorists moving to reinforce the shattered battalions in the central cities of the Strip. Hamas terrorists have become more passive in recent weeks, mostly launching scattered attacks. IDF intelligence believes Hamas is using this time to regroup and reorganize. US Signals Possible Pause in Weapons Shipments

In a CNN interview, President Biden said he will pause shipments of bombs and artillery shells to Israel if they start an extensive military operation in Rafah, beyond the current limited operation. The weapons shipment being delayed includes 1,800 900-kilogram bombs and 1,700 225-kilogram bombs. The US is considering delaying further arms shipments amid the widespread destruction heavy bombs have caused in the Strip.

Israel Disappointed But Not Surprised by US Decision

In Israel there is frustration and disappointment following the US decision. The talks on the subject have been a dialogue of the deaf, with Israel trying to convince US officials that its plan to protect civilians in Rafah would succeed. Rafah crossing, located approximately 3.5km from the Israeli border, is a key entry point for the Hamas-controlled Gaza Strip. Now under IDF control, this crossing holds strategic importance for the smuggling of weapons and money into the Strip by Hamas, which they use to wage war against Israel.

Amidst the escalating conflict, efforts for a diplomatic resolution are also underway. However, these endeavors have fallen prey to ambiguity and confusion. Why is Israel Being Accused of Genocide?

South Africa has referred Israel to the International Court of Justice (ICJ), accusing the Middle Eastern country of committing genocide in Gaza. This follows reports that allege that over 22,000 people, mostly civilians, have been killed in the Gaza Strip since the start of the October 7 Hamas-Israel war.

In this article, we'll discuss South Africa's genocide allegations against Israel. We'll also explain the nature of the ICJ and the weight of its rulings.

On October 7, 2023, Hamas, an Iran-funded terror group, carried out a coordinated attack on random Israeli towns, killing 1,200 people and kidnapping some 240 others. The attack, which came at a time of rising Israel-Palestine tensions, was described as one of the worst terrorist attacks in history.

Israel's military, the Israel Defense Forces (IDF), responded to the attack by carrying out air strikes and a ground offensive in Gaza. This led to the deaths of over 22,000 people in Gaza, a figure provided by the Hamas-run health ministry.

South Africa subsequently filed a case at the ICJ, accusing the Israeli government of having an intent to commit genocide against Palestinians.

What is the International Court of Justice (ICJ)?

The International Court of Justice (ICJ) is the principal judicial organ of the United Nations (UN) formed in 1945. This court exists to settle legal disputes between states, promote international cooperation, and contribute to the development of international law.

The ICJ comprises 15 judges elected by the UN General Assembly and Security Council. These judges serve nine-year terms, and no two judges can be nationals of the same country. The court operates year-round, holding regular sessions and emergency sessions when required. Proceedings involve written and oral phases, with parties presenting their arguments, evidence, and witnesses.

The ICJ relies on various sources of international law, including treaties, customary law, general principles of law, and judicial decisions. It applies principles of equity and justice to ensure a fair and impartial resolution of disputes.

The rulings of the court are binding and final but cannot be forced on any country. As such, some countries choose to ignore or not fully comply with ICJ decisions.

Throughout its history, the ICJ has heard numerous landmark cases. Notable examples include The Republic of Nicaragua v. The United States of America, where the court addressed issues of state responsibility and intervention, and the Kosovo Advisory Opinion, which examined the legality of Kosovo's declaration of independence.

Over the years, the ICJ has seen the participation of esteemed judges from diverse legal backgrounds. Notable presidents have included Sir Muhammad Zafrulla Khan, Sir Robert Yewdall Jennings, and current president Joan E. Donoghue.

For many, it is hard to understand the basis of South Africa’s genocide allegation.

Hostage situation: Hamas began this war, not Israel, and to this day, the terror group still holds a number of Israeli hostages, including women and children. Some abductees are under age 3.

Civilian casualties: While it’s unfortunate that civilian deaths have been recorded, all casualties are within combat zones. Israel is extremely careful with civilians and has teams of lawyers that check military decisions in real-time to ensure fewer civilian casualties.

Use of human shields: There is evidence to suggest that Hamas uses civilians in Gaza as human shields. Hamas also operates from schools, hospitals, UN shelters, and places of worship in order to hide behind civilians. Other reports suggest that Hamas terrorists sometimes deploy civilians, including children, to fight tanks and plant explosives.

Israel’s military approach: Israel is a military superpower and could have easily killed more than 1% of Gaza’s population if it truly had a genocidal intent. Instead, The IDF sends ground forces on dangerous missions to Gaza in order to reduce civilian deaths. The easier solution, if Israel had no regard for civilian casualties, would be indiscriminate bombing. If Israel intends genocide, why would they risk their soldiers' lives to reduce civilian casualties?

Gazan population: The Hamas-run Gazan Ministry of Health (MoH), says some 23,210 Palestinians have been killed in Gaza since the Hamas war — a figure equivalent to about 1% of the Gazan population. Although this figure is tragic, it is hard to describe the deaths of 1% of a people as genocide.

Comparisons to death rates in other conflicts: Compared to casualty rates in conflicts like the one in Ukraine (which South Africa has refused to condemn), the killings in Gaza (though unfortunate) are relatively low. 

Hamas's intent: Many argue that if there's any genocidal intent, it should be attributed to Hamas. The terror group has  a call for the genocide of Jews in its charter. “The Day of Judgment will not come about until Muslims fight the Jews (killing the Jews) when the Jew will hide behind stones and trees. The stones and trees will say: O Muslims (…) there is a Jew behind me, come and kill him. “Only the gharkad tree [evidently a certain kind of tree] would not do that because it is one of the trees of the Jews.” - Article 7 of the Charter of Hamas.

Iran's plot: Hamas's ally, Iran also expresses similar sentiments. In 2005, the country said it would wipe Israel off the face of the map. In President Mahmoud Ahmadinejad's own words,  “Anybody who recognizes Israel will burn in the fire of the Islamic nation's fury, … any [Islamic leader] who recognizes the Zionist regime means he is acknowledging the surrender and defeat of the Islamic world." “... There is no doubt that the new wave [of attacks] in Palestine will wipe off this stigma [Israel] from the face of the Islamic world." “Israel must be wiped off the map.”

Based on these arguments, it's safe to say South Africa’s genocide claim lacks merit.

What is the History of South Africa’s Relationship With Israel?

South Africa's genocide claim against Israel has undoubtedly further strained the already shaky relationship between the two countries. Here is an overview of key phases in their historical ties:

In the 1940s, South Africa and Israel had a friendly relationship. The African country became one of the first states to give official recognition to Israel.

Israel, in turn, opened a consulate-general in Pretoria.

In the 1950s, the relationship between Israel and South Africa deepened, with increased economic cooperation.

During the 1950s-1960s, apartheid issues, and related UN debates complicated the relationship between Israel and South Africa.

The end of apartheid in the early 1990s marked a turning point in the relationship. South Africa's new government, led by Nelson Mandela, criticized Israel's policies toward the Palestinians. The two countries also adopted different positions on various other international issues.

During parts of the 21st century, Israel and South Africa maintained diplomatic relations, but these are often strained due to differences in their approaches to the Israeli-Palestinian conflict. South Africa has been critical of Israel's policies, leading to occasional diplomatic tensions.

As of 2023, South Africa's ruling African National Congress (ANC) maintained a strong pro-Palestinian stance.

The ANC accused Israel of apartheid against Palestinians, a claim strongly resonating with South Africa.

In November 2023, South Africa recalled its ambassador to Israel and closed its embassy in the Middle Eastern country.

South African lawmakers also voted to close down Israel's embassy in Pretoria.

Weeks after the October 7 attacks, a group of Hamas officials visited South Africa. 

More on the South Africa-Israel Genocide Case at the ICJ

South Africa's legal team, led by justice minister Roland Lamola, argues that Israel’s military campaign in Gaza violates the Genocide Convention. “The level of Israel's killing is so extensive that nowhere is safe in Gaza," Adila Hassim, one of South Africa's lawyers, told the court.

"As I stand before you today, 23,210 Palestinians have been killed by Israeli forces during the sustained attacks over the last three months, at least 70% of whom are believed to be women and children," Hassim added.

Meanwhile, Israel has strongly rejected the accusation of genocide, saying that it is only acting in self-defence. Prime Minister Benjamin Netanyahu, in a video statement, reacted to South Africa’s opening arguments. 

 "The hypocrisy of South Africa knows no bounds…The state of Israel is accused of genocide at a time when it is fighting genocide.”

"Today, we witnessed one of the greatest shows of hypocrisy in history and a series of baseless and false claims. South Africa is ignoring the fact that Hamas terrorists infiltrated Israel, murdered, executed, massacred, raped, and kidnapped Israeli citizens, just because they were Israelis, in an attempt to carry out genocide.”

Dr. Gilad Noam, one of Israel's lawyers, presented the following closing arguments in his client’s defense:

“Entertaining the applicant’s request would weaken efforts to punish genocide and instead of [the court] being an instrument to prevent terrorist horrors would turn it into a weapon in hands of terrorist groups who have no regard for humanity and rule of law,” said Noam.

South Africa’s stance, if universally accepted, “Would signal to terrorist groups that they can commit war crimes and crimes against humanity and then seek the protection of this court,” he added. .

What Other Countries and Organizations Have Said About the Case

Parts of a Palestinian foreign ministry statement read: “International Court of Justice... is a historic event in the process of the joint Palestinian and South African struggle in the face of the injustice and genocide.”

"Holding Israel, the illegal occupying power, accountable, using all legal tools, and through international justice institutions and international law enforcement, is the main focus of the legal strategy of the State of Palestine, and the core of the diplomatic and international movement.

"...What encouraged Israel and its various tools, including government officials, military personnel, and colonialists, to commit crimes, leading to the commission of, and incitement to commit, the crime of genocide, is due to international failure, the failure to take practical steps to hold it accountable..., and supplying Israel with various types of lethal weapons and political support…”

Meanwhile, Hamas spokesman Sami Abu Zuhr said, "The Palestinian people are following the court session in The Hague with great concern and interest ... We urge the court to reject all pressure and take a decision to criminalize the Israeli occupation and stop the aggression on Gaza.”

German foreign minister Annalena Baerbock:

"It is a fact that genocide preconditions the intention to destroy or partly destroy a group because of their nationality, ethnicity, race or religion. I cannot detect any of this intention by Israel in its self-defence against an armed terror group, Hamas. We will observe the hearing closely."
